Your continued use of ECO Friendly, following the addition of changes to these Terms and Conditions is a declaration of your acceptance of said changes.

Introduction:

You may use the ECO Friendly, under the provided Terms and Conditions, for the purpose of benefitting from the services provided under this Online Platform. We primarily provide the following services through the said Online Platform for our customers as follows:

• Mobile car washing services;
• Exterior and Interior Cleaning, Car Wash and Dry; and
• Eco-Friendly Options – Use of water-saving techniques and biodegradable cleaning products.

In order to register yourself on ECO Friendly, you agree to give accurate and up to date information about yourself and promptly update such information in case of any changes. Having a valid registration entitles you to have a personal account with a username and password, thus entitling you to benefit from our services.

We are solely responsible for the quality of the services we provide and performance of our profession.

Being the account owner, you are entirely responsible for all activities conducted under this account and/or under the relevant password. Furthermore, you must notify us immediately of any unauthorized use of your password or account in case you forget your password.

Acceptance of Terms

You acknowledge that you have read this Terms and Conditions prior to your use of the ___ ECO Friendly , and your account. Each time you use the ECO Friendly, you agree to be bound by this Terms and Conditions and any subsequent amendments or modifications as may be made from time to time.

After registering on ECO Friendly, your registration will be validated, and you will have your own Username and Password that will give you and only you access to the Services on ECO Friendly, whereupon you are an authorized user and is bound by the below terms and conditions.

The Registration Process, Activation Code and Password

During the registration process, the Website will allow you to assign a User ID and a Unique Password to access your account. The account will remain inactive, till you activate it using the activation link sent to the provided Email address used during the registration process including the Pin Code. The activation code will enable you to start using your account with all its features and services. You must use your user ID and Password to access the Service. Your Password is for your sole and exclusive use and has the same effect as your written signature in connection with the Service. You should treat your Password with the same degree of care and secrecy that you use to protect your other personal identification numbers or sensitive personal financial data. Remember it is your responsibility to protect your Account Password. In case of suspecting that there are some unauthorized actions done on your account or in case you lost your password, or your password got stolen; contact us AT ONCE at ECO Friendly’s email: ___________,

Please change your password immediately in such situation. Notifying us immediately is the best way of minimizing possible losses.

You acknowledge that the sharing or assigning of your username and password with other persons (collectively as “Multiple Use”) may cause irreparable harm to us and you shall, to the full extent permitted by applicable law, indemnify us against any loss or damages suffered by us as a result of such multiple use. You undertake to notify us immediately of any unauthorized use of your username or password or any other breach of security. You agree that we shall not be liable for any loss or damages arising from your failure to comply with this term.

If you are an entity, you agree that all officers, employees, agents, representatives and other persons who have access to your username and/or password have been duly authorized by you to use your Account or the Platform Services on your behalf and to legally bind you to any online concluded transactions. You shall be responsible for all actions of your current and former officers, employees, agents, representatives and other persons who access your Account or the Platform Services using your username and password, regardless of whether such person was duly authorized by you to do so.

Following the activation of your account, ECO Friendly will require to fill out a set of vital data and information.

Platform Services:

Are the services provided by us as a platform to facilitate your Online Transactions. You should create an Account to enjoy our Platform Services as mentioned above.

Following the creation of your account and the duly activation of your account, you are entitled to benefit from all services mentioned in the Online Platform.

General Terms & Conditions

You agree that you will not use the submission or any of the  ECO Friendly content in any unlawful manner or in any manner that could damage, disable or impair the Website.

You should not use  ECO Friendly to transmit any material or share any submission that is defamatory, offensive, inappropriate, unlawful or otherwise objectionable. Any breach to this part or any of the Terms and Conditions shall be your sole responsibility and you shall bear the consequences arising from such breach.

In case of the abuse of  ECO Friendly in any manner, we reserve the right to revoke your access thereto immediately without your prior notice.

Under certain exception circumstances, we may have no option but to suspend, withdraw or restrict the availability of all or any part of our site for business and operational reasons. Obligations & Rights of The User

• The right to use or benefit from the  ECO Friendly account is limited to the user alone, and not others, and the user is obligated at all times not to allow or enable any other person(s) to use or benefit from its ECO Friendly account.
• You cannot use ECO Friendly if:

1. your account has been previously disabled by us due to breach of these Terms and Conditions.

• The user is obligated to notify us directly of any instructions that may be issued by any person who is not allowed or is suspected to have accessed the user’s the ECO Friendly   
• In the event that the user suspends the E-mail address linked to his account, by so doing the user will lose one of the conditions concerning the use of the service, accordingly, the user will automatically lose his right to use the service through the suspended E-mail address.
• You will use your account and the services in good faith and in compliance with all applicable laws and regulations.
• The information and materials you provide in connection with your account or your use of the services is true, complete, lawful and accurate, and is not false, misleading or deceptive.
• You shall be solely responsible for payment of any taxes, duties or any financial charges that may be imposed on any products or services purchased or supplied through the services .

Our obligations and rights

• Our obligations are limited to implementing the instructions issued by the user after they are accepted by us.
• We are not responsible if the data provided by the user is incorrect.
• Eco Friendly shall not be held liable, under any circumstances, for the loss of, or damage to, any personal belongings or valuables left inside the car during the provision of interior or exterior cleaning services. It is the sole responsibility of the customer to ensure that all personal items are removed from the car prior to the commencement of the service. By using our services, the customer acknowledges and accepts full responsibility for their personal belongings and waives any right to claim against Eco Friendly in this regard.
• We are not obligated to provide any compensation as a result of incorrect data.
• The user has no right to cancel or amend any request after its due date.
• We will not transfer your information cross border to any organization unless we have your prior consent or in cases required by the laws of the Arab Republic of Egypt.
• We do not guarantee that our site will be secure or free from bugs or viruses.

Personal data and privacy:

• We may request or collect certain information about you when you use the Online Platform. The information you give us shall include your name, address, username/nickname, age, gender, postcode, country, email address, phone numbers, and any feedback/submissions you might provide, and in case you are a legal entity, you shall provide us with the commercial register number, tax card number, articles of association, and any other information that is deemed necessary from our side.
• We are dealing with your personal information with complete privacy and confidentiality, being our responsibility towards you. We are obliged and complied by the Data Protection law no.151 of 2020 and any related laws of the Arab Republic of Egypt to maintain the confidentiality of the personal information of the provider.
• We will not use the shared/provided personal information other than is prescribed herein, unless otherwise officially required by governmental authorities, and/or courts.

Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights on our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organization to content posted on our site.

You agree that all materials, products and services provided on this website are the property of Eco Friendly, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors.

Force Majeure

Neither you or us shall be held liable for any default, delay or failure in performing its obligations under this Agreement resulting directly or indirectly from acts of nature, forces or causes beyond the reasonable control of such Person, including:

(i) a fire, flood, elements of nature or other acts of God,

(ii) an outbreak or escalation of hostilities, war, riots or civil disorders, or an act of terrorism;

(iii) Internet failures, computer, telecommunications, electrical power failures or any other equipment failures;

 (iv) a labor dispute (whether or not employees’ demands are reasonable or within the Person’s power to satisfy),

 (v) acts or omissions of a government authority prohibiting or impeding the affected Person from performing its obligations under this Agreement, including orders of domestic or foreign courts or tribunals, governmental restrictions, sanctions, restrictions on foreign exchange controls, etc. or

 (vi) the non-performance by a third party for any similar cause beyond the reasonable control of the Person (collectively, a “Force Majeure Event”).

 If a Force Majeure Event occurs, then on-performing party to these Terms & Conditions will be excused from any further performance of the obligations affected by the event only for as long as the Force Majeure Event continues and the party continues to use commercially reasonable efforts to resume performance.

If you are unable to use the services directly or indirectly due to either system suspension which has been announced  ECO Friendly  in advance, or any Force Majeure Event as defined above, you agree that to the extent permitted by applicable law you will not hold the  ECO Friendly  liable for any default, delay or failure in performing its obligations under this Terms & Conditions.

Governing Law

By using this website, you agree that the laws of the Arab Republic in Egypt, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Eco Friendly and you, or its business partners and associates.

Also, this provision maintenance and the use of the service shall be governed by the laws of the Arab Republic of Egypt and all its rules and regulations.

Amendments

Any amendments to the Terms and Conditions herein may be added to, deleted or amended by ECO Friendly at its sole discretion at any time. You will be deemed to receive notice of any such additions, deletions or amendments upon the posting thereof on the Online Platform. If you do not agree with any such additions, deletions or amendments, you may terminate your subscription to the service in the manner provided below. If you do not do so and continue to use the service then you shall be deemed to have agreed to the additions, deletions or amendments as they are made by  ECO Friendly .

Termination of Service: If you wish to discontinue using the service, you must provide us with a written notice to us through the email stated below. We must receive your written notification ten (10) days prior to the termination date or you can delete your account and your data will be deleted after terminating the services.

Please be advised that in the event of deleting your account on the Mobile Application and the Website or terminating the relation between you and us you all your personal data were collected from our side will be deleted.

In the event of your breach to any of the Terms and Conditions contained herein and in addition to any other legal remedies, we may, following prior notice to you,

• terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions.

Trademarks and Copyrights:

You hereby acknowledge that all the intellectual property rights in the Online Platform, whether registered or not registered, information, content, trademarks, software and all the designs, including, but not limited to, photos, videos and etc. shall remain our property, and any application arising out of  ECO Friendly. The entire contents of  ECO Friendly are protected by the Intellectual Property Rights Law as copyright. All rights are reserved.

You will have no right to use, copy, display, perform, create derivative works from, transmit or share the materials or content available on the Online Platform than as may be reasonably necessary to use the services for their intended purpose.

Dispute resolution:

Any disputes, controversies, or differences arising out of the implementation, interpretation, performance of these Terms and Conditions, shall be settled by the Cairo Courts in the Arab Republic  of Egypt.

Indemnification:

1. You agree to indemnify Eco Friendly and hold your harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
